Juan Raso Delgue presented the book “The Dismissal”

Dr. Raso Delgue launched his book *El despido*: A Study of General Dismissal and 16 Special Regulations on Severance Pay.

In this paper, the author analyzed severance pay based on current Uruguayan case law.

The event, organized by the Graduate School of Business at Universidad ORT Uruguay, took place on Thursday, November 10. It was held in a hybrid format: some participants attended in person at the university’s Pocitos Campus, while others joined online via HyFlex®.

Presentations were given by Dr. Juan Raso Delgue—professor of Labor Law, Social Security, and Labor Relations at the University of the Republic of Uruguay, coordinator of the Labor Relations program at that university, and former professor at the ORT School of Administration and Social Sciences— Dr. Rosario Irabuena—Human Resources Manager at Indutop Uruguay and Paraguay—and Dr. Jorge Rosenbaum—former full professor of Labor Law and Social Security at the University of the Republic of Uruguay and former professor at the ORT School of Administration and Social Sciences—. The event was moderated by Dr. Gerardo Cedrola—professor of Labor Relations and Collective Bargaining, Faculty of Administration and Social Sciences, Universidad ORT Uruguay.

New special layoffs

Raso Delgue explained that the book, in addition to addressing layoffs in general, focuses on special layoffs. “Ten years ago, we associated special layoffs with maternity leave, illness, and workplace accidents. Today, the scope of special layoffs has expanded.”

For example, the expert cited the case of restraining orders issued in cases of gender-based violence. Once such orders are in place—regardless of whether the abuser works at the same location—the employer is obligated to ensure that this distance is maintained in the workplace; otherwise, the employer must provide the victim with special severance pay.

“Beyond its academic aspects, the book serves a very practical purpose. I believe that anyone involved in work organization needs to be aware of all the new developments that arise so they can point out, highlight, or warn the company about the risks that a poor decision can entail.”

An in-depth analysis

Rosenbaum stated: “The book serves as a standard reference in academic circles because it offers invaluable insights. It provides an in-depth analysis—both conceptual and legal—of dismissal.”

He added: “What adds the most value to this work is its focus on practical realities, which stems from the author’s professional experience as well as his ability to interpret reality.”

The Importance of Staying Up to Date

Irabuena, for her part, explained that she has been involved in the field of human resources for over 30 years. During that time, she has worked in various sectors and has observed how difficult it is to terminate an employment relationship, as it has implications on both a personal and family level, as well as consequences for the rest of the team. 

“When a teammate leaves, it affects the rest of us, and that’s something we have to work on from within.”

“From now on, this book ontermination will be our go-to reference,”Irabuena said. “No matter how many years of experience we have in human resources management, we always have questions because hiring and termination practices have been changing. As much as possible, we need to stay up to date to avoid making mistakes.”
